Terms and Conditions of Entry

The prizes and how to enter:

1. Make a purchase at any Torpedo7 store or online at www.torpedo7.co.nz using your Zip Pay in 4 or Pay Longer Account ("Zip Account") to go in the draw to win a $5,000 Summer Pack ("Promotion"). Promotion is only available between 12:00PM NZDT on Monday 18 October 2021 and 11:59PM NZDT on Tuesday 26 October 2021 ("Promotional Period").

2. To enter into this Promotion, you must, during the Promotional Period;

a. Have an active Zip Account; and

b. Make a purchase at Torpedo7 store or online at www.torpedo7.co.nz using active Zip Account ("Eligible Entry")

3. The $5,000 Summer Pack ("Summer Pack") consists of:

4. In the event that an item is out of stock, Zip reserves the right to replace that item with an item of equal or greater value. Summer pack is not redeemable for cash, and items in the pack cannot be swapped or changed at the request of the winner.

5. A winner will be drawn randomly from pool of Eligible Entries on Wednesday, 27th October 2021 by Zip in an online draw.

6. Winners will be contacted after the date of the draw but no later than Tuesday, 2nd November 2021, between the hours of 9am and 5pm by phone, on the phone number details that are currently provided on your Zip account. It remains the Zip Account holders responsibility to ensure this is up to date.

7. In the event that a prize winner is not able to be contacted 5 working days after Tuesday 2nd November 2021 , the prize will be redrawn on Wednesday 10th November 2021 on the same terms as the original draw.

8. The winner must agree to their name, region and photo being published on https://zip.co/nz and www.torpedo7.co.nz or other marketing material produced by Zip or Torpedo7, and to any publicity Zip or Torpedo7 requires as a condition of receiving the Summer Pack prize. The winner agrees to make themselves reasonably available for this purpose, without compensation.

9. The winner agrees to grant Zip or Torpedo7 a perpetual and non-exclusive licence to use their entries in all media and the winner will not be entitled to any fee for such use.

10. Entry into the Promotion is deemed to be acceptance of these T erms and C onditions of Entry, the terms and conditions with respect to the Zip Pay in 4 or Pay Later terms and conditions ("Zip Account terms and conditions") and Zip's Privacy Policy. All details and instructions form part of the terms and conditions of the promotion.

11. In the event of a dispute the Promoter's decision is final and binding and no correspondence will be entered into.

12. All amounts stated in these terms and conditions are in New Zealand dollars.

13. Should any transaction be cancelled, refunded or varied in any manner, the Offer will be adjusted in accordance with the cancellation, refund or variation. If at any time the Promoter reasonably believes that you are engaging in this promotion through fraudulent, deceptive, or dishonest actions or means, or you violate these, or your Pay in 4 account terms and conditions, we reserve the right to disqualify your Eligible Entry.

14. The Promoter reserves the right to change these Terms and Conditions without prior notice and at its discretion or to extend, postpone or discontinue the Promotion at any time.

15. The Promoter may refuse to award the Promotion to any participant if, in the Promoter's sole opinion, that participant has violated these Terms and Conditions or has gained an un The Promoter does not make any warranties or representations on the delivery, service, quality, quantity, merchantability, suitability or availability of products sold by Torpedo7. The Promoter shall not be liable, except for any liability that cannot be excluded by law, for any direct, indirect, special, or consequential loss, damage, or personal injury (whether physical or mental) in connection with this Promotion, any products purchased and their use by a winner.

19. A valid purchase and subsequent entry into this competition is deemed acceptance of any applicable Privacy statements and Terms and Conditions.

20. Entry is open to all residents of New Zealand except for employees and their immediate families of The Warehouse Group Limited and its subsidiaries and entities and Zip Co NZ Limited.

21. Any entrant who is under the age of 18 years must have their parent or legal guardian's permission to enter the promotion.

22. Zip reserves the right to extend, postpone, or cancel a competition and to update the terms and conditions without notice.

23. All entries become the property of Zip.

24. Zip may be required by law to disclose any of the information that you provide. Zip will only make the disclosure if it believes, in good faith, that it is required to do so.

25. Zip's decision in relation to any aspect of the promotion is final and binding on every person who enters, and no correspondence will be entered into.

26. Prizes are not transferrable or exchangeable and cannot be redeemed for cash. Zip and Torpedo7 accept no responsibility for any variation in prize value.

27. Zip accepts no responsibility for any tax implications that may arise from acceptance of the prize winnings. Independent financial advice should be sought.

28. Any product images or photos used in promotional material for this competition either in store or online are indicative only.

29. If the winner is under 18 years of age at the closing date of the competition, the prize will be awarded to the winners parent of legal guardian on the winners behalf.

30. Zip reserves the right to verify the validity of entries and to disqualify any entry or refuse to award a prize where false or misleading details have been given by an entrant or an entrant has behaved in a fraudulent or dishonest manner, or otherwise than in accordance with these Terms and Conditions of Entry or the spirit of the promotion.

31. Zip and any other agencies associated with this promotion will not be responsible for any late, lost or misdirected entries, including but not limited to entries not received due to technical problems.

32. Zip, Torpedo7 and any other agencies associated with this promotion will not be liable for any loss or damage whatsoever which may be sustained, directly or indirectly, or for any personal injury suffered or sustained by any entrant or prizewinner in connection with any product purchased for this competition or any prize, except for any liability which cannot be excluded by law.
